1. Introduction

This Privacy Policy describes how Kuchinunu, Inc. (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information in connection with our consumer-facing product, My Daily Doula(the “Service”), accessible via the web application at app.mydailydoula.com, our website at mydailydoula.com, and through integrated messaging channels such as WhatsApp.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree with any part of this Privacy Policy, please do not use the Service.

2. Who We Are

My Daily Doula is a product of Kuchinunu, Inc., a C-Corporation incorporated in the State of Delaware, United States. Kuchinunu, Inc. is the data controller responsible for processing your personal information under this Privacy Policy.

3. Information We Collect

3.1 Information You Provide Directly

  • Account Information. When you create an account, we collect your name, email address, and authentication credentials. If you choose to sign in via Google OAuth, we receive your name, email address, and profile photo from Google.
  • Onboarding and Profile Data.During onboarding and through your profile settings, you may provide information including your pregnancy stage (trying to conceive, pregnant, or postpartum), estimated due date or baby's birth date, preferred name, and other preferences relevant to personalizing your experience.
  • Conversation Data. When you interact with Della, our AI-powered doula companion, we collect the content of your messages and any information you voluntarily share during those conversations.
  • Contact Information. If you opt into WhatsApp or SMS messaging, we collect your phone number.
  • Communications. If you contact us for support or other inquiries, we collect the information you provide in those communications.

3.2 Information Collected Automatically

  • Device and Usage Data. We automatically collect certain technical information when you use the Service, including your device type, operating system, browser type, IP address, and general usage patterns such as pages viewed and features accessed.
  • Push Notification Tokens. If you enable push notifications, we collect device tokens necessary to deliver notifications to your device via Firebase Cloud Messaging.
  • Cookies and Similar Technologies. We use essential cookies and local storage to maintain your session, remember your preferences, and ensure the Service functions properly. We do not use cookies for advertising or behavioral tracking.

3.3 Information from Third-Party Sources

  • Google OAuth. If you authenticate with Google, we receive limited profile information (name, email, profile photo) as authorized by you during the Google consent flow.

4. How We Use Your Information

We use the personal information we collect to:

  • Provide, maintain, and improve the Service;
  • Personalize your experience, including tailoring Della's responses based on your pregnancy or postpartum stage, preferences, and prior conversations;
  • Process and respond to your messages through the web application, WhatsApp, or SMS;
  • Send you push notifications, reminders, and other communications related to the Service;
  • Send you transactional emails, such as account verification and service updates;
  • Monitor and analyze usage trends to improve functionality and user experience;
  • Detect, investigate, and prevent fraudulent or unauthorized activity;
  • Comply with legal obligations and enforce our terms of service;
  • Respond to your support inquiries.

5. Legal Basis for Processing

Where applicable law requires a legal basis for processing personal information, we rely on the following:

  • Performance of a Contract. Processing necessary to provide the Service to you, including account creation, message delivery, and personalized AI responses.
  • Legitimate Interests. Processing necessary for our legitimate business interests, such as improving the Service, ensuring security, and understanding usage patterns, provided those interests are not overridden by your rights and freedoms.
  • Consent. Processing based on your voluntary consent, such as opting into push notifications, WhatsApp messaging, or SMS communications. You may withdraw consent at any time.
  • Legal Obligation. Processing necessary to comply with applicable legal or regulatory requirements.

6. How We Share Your Information

We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising. We may disclose your information in the following limited circumstances:

6.1 Service Providers

We engage trusted third-party service providers to perform functions on our behalf. These providers are contractually obligated to use your information only as necessary to provide their services to us and are bound by confidentiality obligations. Our service providers include:

  • Anthropic(AI language model provider) — processes conversation content to generate Della's responses;
  • Supabase(database and authentication infrastructure) — stores account data and provides authentication services;
  • Twilio(messaging services) — delivers WhatsApp and SMS messages;
  • Google Firebase(push notification services) — delivers push notifications to your device;
  • Resend(email delivery) — sends transactional emails;
  • Vercel(web hosting) — hosts our web application;
  • Railway(backend hosting) — hosts our backend infrastructure.

6.2 Legal Requirements

We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws, respond to a valid court order, judicial or other government subpoena, or warrant, or to otherwise cooperate with law enforcement or regulatory agencies.

6.3 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your personal information may be transferred to the acquiring entity. We will notify you via email or a prominent notice on our Service before your information becomes subject to a different privacy policy.

6.4 With Your Consent

We may share your information with third parties when you have given us your explicit consent to do so.

6.5 SMS / Text Messaging

If you opt in to receive text messages from Daily Doula, message frequency varies and is typically 1–3 messages per day. Message and data rates may apply. You can opt out at any time by replying STOP, or reply HELP for assistance. We do not sell or share your mobile phone number or SMS consent with third parties or affiliates for their own marketing or promotional purposes. Your phone number is shared only with our messaging provider (Twilio) solely to deliver the messages you requested.

7. Artificial Intelligence and Automated Processing

The Service uses artificial intelligence technology, specifically large language models provided by Anthropic, to power Della, our AI doula companion. When you send a message to Della, the content of your message, along with relevant context from your profile and prior conversations, is transmitted to Anthropic's API for processing.

Important disclosures regarding AI processing:

  • Della is an AI companion and is nota medical professional. Della's responses do not constitute medical advice, diagnosis, or treatment recommendations.
  • Your conversation data is transmitted to Anthropic solely for the purpose of generating real-time responses. We do not authorize Anthropic to use your data for training AI models.
  • AI-generated responses may be inaccurate or incomplete. You should always consult qualified healthcare providers for medical questions.
  • We do not use automated decision-making that produces legal or similarly significant effects on you.

8. Health and Wellness Information

The Service is designed to provide general support during pregnancy, postpartum, and the trying-to-conceive journey. In the course of using the Service, you may voluntarily share health-related information such as your pregnancy stage, due date, symptoms, or wellness concerns.

Please note:

  • My Daily Doula is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). The information you share with us is not protected health information (PHI) within the meaning of HIPAA.
  • We treat any health-related information you share with heightened care and do not sell, rent, or share such information for marketing or advertising purposes.
  • Health-related information is used solely to personalize your experience within the Service and is subject to the same security safeguards described in this Privacy Policy.
  • The Service does not replace professional medical advice. Always consult your healthcare provider for medical decisions.

9. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you the Service. If you request deletion of your account, we will delete or anonymize your personal information within thirty (30) days, except where we are required by law to retain it or where retention is necessary for legitimate business purposes such as resolving disputes or enforcing our agreements.

Conversation data is retained for the duration of your account to enable continuity of your interactions with Della. You may request deletion of your conversation history at any time by contacting us.

10. Your Rights and Choices

10.1 All Users

Regardless of your location, you may:

  • Access and update your account information through your profile settings;
  • Opt out of push notifications through your device settings;
  • Opt out of WhatsApp or SMS messaging at any time;
  • Request deletion of your account and associated data;
  • Contact us with questions or concerns about your data.

10.2 California Residents (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), provides you with additional rights regarding your personal information:

  • Right to Know. You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collection, and the categories of third parties with whom we share your personal information.
  • Right to Delete. You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to Correct. You have the right to request correction of inaccurate personal information.
  • Right to Opt-Out of Sale/Sharing. We do not sell your personal information and do not share it for cross-context behavioral advertising. No opt-out is necessary.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

10.3 European Economic Area, United Kingdom, and Swiss Residents (GDPR)

  • Right of Access. You may request a copy of the personal data we hold about you.
  • Right to Rectification. You may request that we correct inaccurate or incomplete personal data.
  • Right to Erasure. You may request deletion of your personal data where there is no compelling reason for its continued processing.
  • Right to Restrict Processing. You may request that we restrict processing of your personal data in certain circumstances.
  • Right to Data Portability. You may request a copy of your personal data in a structured, commonly used, and machine-readable format.
  • Right to Object. You may object to processing of your personal data based on legitimate interests.
  • Right to Withdraw Consent. Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.
  • Right to Lodge a Complaint. You have the right to lodge a complaint with your local data protection supervisory authority.

11. Children’s Privacy

The Service is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us at [email protected], and we will take steps to delete such information promptly. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will delete that information as quickly as practicable.

12. Data Security

We implement reasonable and appropriate technical and organizational measures designed to protect the personal information we process against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL), encryption of data at rest, access controls, and regular security assessments.

However, no method of electronic transmission or storage is completely secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security.

13. International Data Transfers

Your personal information may be transferred to and processed in countries other than your country of residence, including the United States, where our servers and service providers are located. These countries may have data protection laws that differ from those in your jurisdiction.

Where required by applicable law, we implement appropriate safeguards for such transfers, including standard contractual clauses approved by the European Commission or other legally recognized transfer mechanisms.

The Service may contain links to third-party websites, applications, or services that are not operated or controlled by us. This Privacy Policy does not apply to third-party services. We encourage you to review the privacy policies of any third-party services you access through the Service.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors.
